The Sindh High Court, hearing a plea regarding the recovery of missing persons, raised questions about forced disappearance of people and ordered the police authorities to submit the progress report.
During the hearing the court was informed that the JITs declared the family members of Muhammad Iqbal, Asma Nadeem, Sher Muhammad Khan as forced disappearances.
The focal person of the home department said that after the forced disappearance, financial assistance was approved for the families of 29 missing persons on the orders issued from the CM House.
The court remarked that when it is admitted that the citizens have been forcibly disappeared, the reason should also be given. It should also be told where the citizens are and which organisation has detained them.
The special public prosecutor stated that the declaration of forced disappearance does not mean that any institution has confirmed the disappearance or detaining then. The court remarked then it should be told what is the criteria and procedure for declaring forced disappearance. Under which law missing of citizens is declared as forced disappearances?
The special public prosecutor Habib Ahmed Advocate said, “It is reviewed in the light of the allegations of the petitioners regarding the missing citizens. There is no law regarding it, this practice started in the light of Islamabad High Court decision.”
The court remarked that the files in this regard, including the decision of the Islamabad High Court, should be presented at the next hearing and ordered the police authorities to speed up steps to recover the missing persons and submit the progress report.
Encroachment
A two-member bench of SHC, headed by Justice Salahuddin Panhwar, hearing a petition regarding alleged encroachment on nullah near Qasba Mor in Orangi Town, ordered the Director SBCA West to personally visit the site and submit the report.
Petitioner’s counsel submitted that a petrol pump has been built on the drain land.
The lawyer of the petrol pump owner took the stand that the petrol pump is legally built on the registered plot. The applicant has mentioned his address of our plot. Counsel for the petitioner submitted that there is a drain next to the petrol pump. Now they are trying to capture more land. The court directed the director SBCA west to conduct a personal inspection of the concerned plot and submit a written reply at the next hearing.
Admission restored
The Sindh High Court directed to give admission to the petitioner considering the merits of the application against cancellation of her admission in Shaheed Ms. Bhutto Medical College.
A hearing was held in front of a two-member bench headed by Chief Justice Sindh High Court Justice Aqeel Ahmad Abbasi against the cancellation of admission in Benazir Bhutto Shaheed Medical College.
The petitioner’s counsel stated, “The college administration has canceled the admission of my client and given admission to some other student. My client’s year will be wasted. The court is requested to take notice of this situation.”
The court allowed restoration of the admission and remarked, if the admission was on merit then it should be restored. The court disposed of the application.
