An anti-terrorism court on Tuesday handed down a collective sentence of 11-year imprisonment to two street criminals in a case pertaining to attempted murder and encounter with police.
Arif Shah and Ikram were found guilty of attacking a police party to avoid being caught within the limits of the Peerabad police station last year. The ATC-III judge, who tried the accused in the judicial complex inside the central prison, ruled that the prosecution successfully proved its case against them.
He awarded ten years in jail to the convicts for offence punishable under Sections 324 (attempted murder) of the Pakistan Penal Code and one year for offence punishable under 353 (assault or criminal force to deter public servant from discharge of his duty) of the PPC.
Both were told to pay a collective fine of Rs60,000 each or undergo additional seven-month imprisonment on default. The judge ordered accused Arif to pay compensation equal to the expenses incurred on the treatment of Constable Zaheer Baloch, who was injured in the exchange of fire with them, and another Rs100,000 for the anguish he suffered.
Additionally, Arif was awarded five-year imprisonment and a Rs40,000 fine for possessing an unlisenced firearm. The convicts were subsequently remanded back to prison to serve out the sentences that shall run concurrently.
According to the prosecution, the police during snap checking near KDA Chowrangi signalled the accused on a motorcyclist to pull over. Instead of stopping, it said the accused attempted to flee the scene.
An exchange of fire took place between the police and the accused near Banaras flyover, resulting in injuries to Constable Zahid and two passers-by, the prosecution mentioned, adding that the accused were later arrested and a pistol was recovered from their possession.
