LHC seeks reply on plea challenging Sher Afzal’s detention


LAHORE:

The Lahore High Court (LHC) on Friday issued notices to the deputy commissioner of Lahire and sought a reply by December 18 on a plea challenging the detention order which led to PTI Senior Vice President Sher Afzal Marwat’s arrest under 3MPO.

The court, presided by Justice Shehram Sarwar Chaudhry, was requested to side aside the detention order of Marwat and declare it illegal and unlawful. The court was further prayed that the respondents in the case be directed to release the PTI leader till the disposal of the petition. 

Petitioner Khalid Lateef Khan, brother of Marwat, filed the plea through counsel and senior lawyer Latif Khosa, contending that no FIR, arrest warrant or detention order was shown despite repeated requests to the police officials by the lawyers who were accompanying Marwat.

The counsel also pointed out that there was no such intelligence report available before December 14. He contended that an intelligence report issued on the same day that Marwat was in Lahore showed malafide intent by the deputy commissioner and senior police officials. 

Khosa implored the court in the petition that the detention order was issued “merely relying upon the assumption” and added that there is no evidence on record or history of disturbance by Marwat. 

The petition further added that there was no danger to public peace or safety and neither was there and threat of a law and order situation being created with the presence of the PTI leader in the provincial capital. 

Marwat’s arrest

Heavy police contingents on December 14 arrested Marwat under 3MPO for a period of 30 days following intelligence reports that he had the potential to gather amob and attack government buildings, and sensitive installations and disturb peace endangering the life of innocent people.

He was arrested in front of the LHC’s main gate as he came out of the premises after attending a lawyer’s convention.

Police officials asked him to step out of his vehicle after some arguments and after he did, he was taken towards a police vehicle. He was first taken to Mozang police station and then shifted to Kotlakhpat jail.
