Delhi government has legislative and executive powers over administrative services, the Supreme Court said in its judgment today, after years of tussle between the Arvind Kejriwal government and the Lieutenant Governor.

A five-judge Constitution Bench led by Chief Justice of India DY Chandrachud was considering whether the Central government or the Delhi government has administrative control over transfers and postings of civil servants in the national capital.

Delhi Government Has Control Over Administrative Services, Supreme Court Rules

The Delhi government has control over administrative services, the Supreme Court has said. Only services under Public Order, Police and Land are excluded from the purview of the Delhi government.

Delhi Lt Governor Bound By Decision Of Elected Government On Services: Supreme Court
Lt Governor shall be bound by the decision of NCTD over services apart from land, police and law and order, Supreme Court said.

If the officers stop reporting to the ministers or do not abide by their directions, the principle of collective responsibility is affected, Supreme Court said.

In a democratic form of govt, real power of administration must rest on the elected arm of the government, says Supreme Court.

Ensure Governance Of States Is Not Taken Over By Union: Supreme Court

While National Capital Territory of Delhi is not a full fledged state. It is not a State under first schedule yet it is empowered to legislate.Union has power and state too has the power but the executive power of the state will be subject to the law existing of the union. It has to be ensured that governance of states is not taken over by the Union, CJI DY Chandrachud said.

How The Tussle Between Delhi Lt Governor And AAP Government Began

The case has its roots in 2018, when the Arvind Kejriwal government had gone to court, arguing that its decisions were constantly being over-ridden by the Lieutenant Governor, who acts as the Centre’s representative in Delhi.

Bureaucrats’ appointments were cancelled, files were not cleared, and basic decision-making was obstructed, the Delhi government had told the court.

In a landmark verdict next year, the top court said the elected government of Delhi is the boss.
